TEMP FORM TESTING

LIABILITY RELEASE I understand participation in my own or my child or ward’s chosen Program(s) involves exposure to the inherent and other risks of skiing and/or snowboarding that cannot be eliminated. I also understand participation in my or their chosen Program(s) may require the use of ski lifts and that I/they may ride lifts alone or with other guests and that the use of lift involves a potential risk of injury. In consideration of my/them being allowed to participate in this instruction program, I HEREBY EXPRESSLY ASSUME ALL RISK associated with participation in my/their chosen Program(s) including all risks associated with skiing and/or snowboarding, riding lifts, renting equipment, and skiing or snowboarding on terrain or using equipment intended to improve or enhance skills. Despite my understanding of the foregoing risks, I, AGREE NOT TO SUE, TO RELEASE FROM LIABILITY AND TO DEFEND, INDEMNIFY AND HOLD HARMLESS MCINTYRE SKI SCHOOL, INC., MCINTYRE SKI A REA, LLC, B&B HOLDINGS, LLC AND THE CITY OF MANCHESTER, and their representatives, owners, employees and agents for any damages or injury arising out of participation in my/their chosen Program(s) regardless of the alleged cause, including NEGLIGENCE. In case of malfunction of my ski or snowboard equipment, I authorize McIntyre Ski Shop/School employees to repair as necessary or replace with McIntyre Ski Shop equipment if required, so that I/they may continue participation in my/their chosen Program(s). I understand that the foregoing is a LIABILITY RELEASE and that is legally binding on me, our heirs and our legal representatives and my child or ward if applicable. I acknowledge that the foregoing is binding during the current ski season. This agreement is governed by New Hampshire law. If any provision of this agreement is determined to be unenforceable, all other provisions shall be given full force and effect. I and my child or ward understand that video or photographic images of us may be taken by McIntyre Ski Area, LLC and give permission for any use of those images by McIntyre. I HAVE READ, UNDERSTAND AND FREELY ENTER INTO THIS LIABILITY RELEASE.

I understand that no refunds will be issued for any reason at any time.

I understand that McIntyre Ski Area has the right to reschedule classes due to inclement weather or other unforeseen reasons. If I cannot attend a scheduled or recrudesced class, the class is forfeited. There is no individual make up classes. Any schedule changes will be posted on the McIntyre website the day of my lesson and an email will be sent to the email I have registered with.
